the allowable administrative drawdown available under the HOME <br /> program of ten (10) percent of the annual funds. Drawdowns for <br /> the payment of eligible expenses shall be made on an as needed <br /> basis to offset the CICD administrative costs on behalf of the <br /> HOME Program, and to further the development of available stan- <br /> dard affordable housing for low income persons. <br /> Payments may be contingent upon certification of the <br /> Subrecipient' s financial management system in accordance with the <br /> standards specified in OMB Circular A-110, Attachment F. <br /> 4. SPECIAL CONDITIONS <br /> The Subrecipient agrees to comply with the requirements of <br /> 24 CFR Part 92 of Federal Regulations pertaining to the HOME <br /> Program and all federal regulations and policies issued pursuant <br /> to these regulations. The Subrecipient further agrees to utilize <br /> funds available under this Agreement to supplement rather than <br /> supplant funds otherwise available. <br /> 6 . A. General Compliance <br /> The Subrecipient agrees to comply with all applicable <br /> federal, state and local laws. and regulations governing the funds <br /> provided under this contract. <br /> B. Independent Contractor <br /> Nothing contained in this agreement is intended to, or shall <br /> be construed in any manner, as creating or establishing the <br /> relationship of employer/employee between the parties. The Sub- <br /> recipient shall at all times remain as independent contractor <br /> with respect to the services to be performed under this Agree- <br /> ment. The City shall be exempt from payment of all unemployment <br /> compensation, FICA, retirement, life and/or medical insurance and <br /> workers' compensation insurance as the Subrecipient is an inde- <br /> pendent Subrecipient. <br /> 3 <br />
