the EMPLOYEE with group life insurance, and EMPLOYEE and <br /> dependent health, hospitalization, and dental coverage in <br /> accordance with that provided the other management employees of <br /> the CITY. However, notwithstanding the foregoing, it is agreed <br /> and understood that the CITY may, at its sole option, modity or <br /> eliminate said insurance or any portion thereof provided that the <br /> EMPLOYEE is treated no differently than other management <br /> employees. <br /> SECTION THIRTEE�i. Public Official Liability Insurance and <br /> Representation by Legal Counsel. The CITY will provide the <br /> EMPLOYEE with public official liability insurance in accordance <br /> with that provided for other officers of the CITY. In addition, <br /> if the EMPLOYEE is sued in any court for any cause of action, <br /> except for criminal, traffic, or misdemeanor offenses, arising <br /> from his actions or conduct as an employee of the CITY, the CITY <br /> shall select and pay for an attorney who shall provide a defense <br /> for said EMPLOYEE, unless the City Council determines that said <br /> EMPLOYEE was acting outside of the scope of his duties when <br /> engaged in the action or conduct which forms the basis of the <br /> suit. <br /> SECTION FOIIRTEEN. Other Insurance. The CITY shall pay the <br /> full cost of providing the EMPLOYEE $300,000.00 (Three Hundred <br /> Thousand Dollars) of individual term life insurance, in addition <br /> to any other insurance coverages provided herein but further <br /> provided that the EMPLOYEE is insurable on a non-rated basis. <br /> SECTION FIFTEEN. Holidays. The EMPLOYEE shall receive the <br /> same paid holidays as are afforded to other CITY officials. <br />
