7. If the Premises, or any part thereof, is <br /> subdivided, no lot owners within such subdivision or <br /> subdivisions shall pay tapping fees to the City for use <br /> of sanitary sewer lateral mains if such mains are <br /> installed by Magna or its successors or assigns and no <br /> fees shall be charged by City to Magna, its successors <br /> or assigns, for connection of any such sanitary lateral <br /> mains to the sewer service extended to the premises. <br /> 8. The City shall extend a municipal watermain in <br /> Hickory Point Road to the east property line of the <br /> Premises, at its expense. If Magna, its successors or <br /> assigns extends said main west in Hickory Point Road, <br /> such extension shall be at the expense of Magna or its <br /> successors or assigns; provided that, if the City <br /> requires that such extension be made with 12" main, the <br /> City will reimburse Maqna, or its successors and <br /> assigns, for the difference in construction costs <br /> between the extension of a 6" main and the extension of <br /> a 12" main. No tapping fees shall be charged to Magna <br /> or lot owners for use of water mains if and to the <br /> extent that such mains are installed or extended within <br /> the property by Magna or its successors assigns. <br /> 9. At such time as the Premises is annexed into <br /> the City, the City shall not, by zoning, restrict the <br /> permissible density of occupancy of such Premises, or <br /> an art thereof to an reater extent than the same <br /> Y P . Y g <br /> would be restricted if zoned R-2 Single Family <br /> Residence District by Ordinance No. 3512, as amended <br />
