DQCIAL EA'�IDYMENP OPPOR'I[�1ITY In the event of the contractor's nori-compliance with the provisions of this Frnial F�nplo�r►ent Opportimity Clause, the Illinois Hunan Rights Act or the I�les and Regulations of the Il linois Departinent of Aianan Rights ("Depart ment") , the o�ntractor may be declared ineligible for future oontracts or subcontracts with the State of Illinois or any of its political subdivisions or aunicipal oorporations, and the o�ntract may be cancelled or voided in �fiole or in part, and such o�er sanctions or penalties may be i�osed or renedies invoked as pravided by statute or regulation. During the performance of this contract, the contractor agrees as follvws: (1) �at it will not discrimiu�ate against any enplvyee or applicant for �lqm►ent because of raoe, color, reliqi�, sex, marital status, national origin or ancestxy, age, physical or mental handicap iuirelated to ability, or an unfavorable discharge fran militazy sexvice: and further that it will examine all jab classifications to det.exmine if mi.nority persons or wrmen are underutilized and wi11 take appmpri.ate affirnnative actian to rectify arry such tmderutilization. (2) Zhat, if it hires additioa�al �loyees in order to perfornn this vontract or any portion thexeof, it will det�xmine the availabi lity (in a000r- danoe with the Departzn�nt's lailes and Regulations) of minorities arrd waren in the area(s) fran which it may reasonably recruit and it will hire for each job classification for w�ich e�nployees are hired in such a way that min�rities and wanen are not imderutilized. (3) Zhat, in all solicitati�s or advertisere.nts for �loyees plaoed by it or on its behalf, it will state that all applicants will be afforded equal opportimity without discriminatioei because of race, color, religion, spx, marital status, national origin or anoestry, age, physical or mental handicap unrelated to ability, or an unfavorable disch�rge fram militazy sezvive. (4) '�at it will send to each labor organization or representative of workers with which it has or is baurid by a collective bargaining or other agreement or tu�xstanding, a notice advisir�g such labor organizati,on or r�pr� sentative of the contractor's obligations under the Illinois AuQnan Rights Act and the Departrnent's lailes and l�egulatio�s. If any su�ch labor organization or rep�esentative fails or refuses to ooaperate with the contractor in its efforts to aa�ly with such Act and Rules ar�d Regulations, the vo�tractor will pxa�tly so notify the Deparbnent and the contracting agenc,y aryd will reccx�uuit emgloyees fsan other �aurces when neoessary to fulfill its obligatioa�s thereunder. (5) Zhat it will sulmit reports as required by the Departinent's Rules and Regulations, furnish all relevant in�nation as may fram time to ti�ne be requested by the Depart�ne.nt or the c�tracting agency, and in all respects oomply with the Illinois Aunan Rights Act and the Departrnent's Rules and Regulations. (6) That it will permit access to all relevant books, reoords, accaunts and work sites by personnel of the oontracting agency and the Depart�ent for puzposes of irivestigation to ascertain canplia�nce with the Illinois Aianan Rights Act and the Department's Rules and R�gulatio�s. (7) Zlzat it will include verbatim or by reference the prwisi.ons of this clause in evezy subvomtract it awards �mder which any portion of the oontract obligations are urxiertaken or ass�aned, so that such prwisions will be binding upon such subo�ritractor. In the same m-uu�er as with ather prwisions of this contract, the oontractor will be liable for ca�Qliance with applicable prwi- sions of this clause by such suboontractors; and fvrther it will �tly notify the contracti.r�g agency and the Department in the event arry subcontractor fails or refuses to voci�ly therewith. In addition, the oontractor will rnt utilize any subcontractor declared by the Illinois A�i Ric�ts Ca�mission to be ineligible for oo�tracts or suboontracts with the State of Illinois ar any of its politi.cal subdivisions or municipal corporatio�s.
