The Owners, or their successors or assigns, shall, <br /> i at the sole option of the City, through its Director of Public <br /> Works, convey to the City, by warranty or trustee' s deed, an 80 <br /> foot wide strip of land, from the south line to the north line of <br /> Parcel #9. Such strip of land to be located as determined by <br /> mutual agreement of the Owners, their successors or assigns, and <br /> the Director of Public Works. <br /> 12. The City will extend Martin Luther King Drive to <br /> Interstate 72 on or before December 31, 1993 . However, Owner <br /> agrees that this date, December 31, 1993, may be extended because <br /> of acts or neglects of the contractor, adverse weather <br /> conditions, labor disputes, land acquisition problems, or other <br /> causes beyond the control of the City. <br /> 13. The City plans to, and will extend, Martin Luther <br /> King Drive to Hickory Point Road when area development warrants <br /> that extension and such extension may include participation by <br /> other public bodies. <br /> 14. The provisions of this agreement shall supersede the <br /> provisions of any ordinance, code or regulation of the City which <br /> may be in conflict with the provisions of this agreement. <br /> 15. If any provision of this agreement is held invalid, <br /> the remainder hereof shall not be affected thereby. <br /> 16 . Time is of the essence of this agreement. <br />
