' � �II�JK���� �'A�E��O <br /> - 5 - <br /> City shall be liable only for payments, as described in paragraph <br /> 7, for property not covered by an approved final plat, or its <br /> equivalent. <br /> 9. The Owners, or their successors or assigns, shall, <br /> within sixty ( 60 ) days of the execution of this agreement, convey <br /> to the City, by warranty deed, Parcel #4, Parcel #5, Parcel #6 <br /> and Parcel #7 . Owners, or their successors or assigns, shall <br /> retain all mineral rights and, further, the conveyance shall be <br /> subject to any existing lease of the mineral rights. Owners, or <br /> their successors or assigns, shall also retain all farming rights <br /> so long as such retention of farming rights does not unreasonably <br /> interfere with the City' s use of the property. By acceptance of <br /> such parcels, the City neither undertakes nor assumes <br /> responsibility for the construction of any roads or streets now <br /> or in the future, but the City reserves the right to construct <br /> such roads or streets at such times and with such financial <br /> participation as it deems to be in the public interest. However, <br /> this limitation on the City' s obligation does not include the <br /> specific obligations assumes by the City under this agreement as <br /> set forth in paragraphs 12 and 13. <br /> 10. The Owners, or their successors or assigns, shall, <br /> within sixty ( 60 ) days of the execution of this agreement, convey <br /> to the City, by quit claim deed, Parcel #8. <br />
