.� 'l, ' • , <br /> Authority (and its Board members, officers, employees or agents) <br /> from and against any such losses or claims. Nothing herein shall <br /> be construed as requiring the Authority (or any Board members, <br /> officers, employees or agents) to acquire or maintain insurance <br /> of any form or nature with respect to any phrase, term, <br /> provision, condition or obligation of this Agreement or any other <br /> matter in connection herewith. The provisions of this paragraph <br /> shall survive the expiration or termination of this Agreement. <br /> (h) Insurance and Claims Against Authority. The City <br /> represents that it is partially self-insured, and, in addition, <br /> maintains reinsurance agreements with insurance companies as to <br /> the payment of claims (as such term is used in paragraph 7(g) <br /> hereof. The City on its own behalf and behalf of any and all <br /> insurers of the City does hereby waive and relinquish any and all <br /> rights against the Authority, or any Board member of the <br /> Authority, officer, employee or agent, in either their respective <br /> individual or official capacities, on account of any claim for <br /> damage or loss, of whatsoever nature, sustained by reason of the - <br /> use of the parking garage or the premises thereof by the City <br /> whether or not resulting from negligence on the part of the <br /> Authority or its Board members, officers, employees or agents in <br /> either their individual or official capacities, including any <br /> right of subrogation against said persons . <br /> -11- <br />
