The City understands and agrees that the <br /> Authority shall not have any duty and makes no covenant with the <br /> City to repair any part or all of the parking garage or the , <br /> premises thereof for any reason whatsoever irrespective of the <br /> condition of the premises . The City accepts the parking garage <br /> and the premises in an "as is" condition. <br /> (j ) Security. The City shall be solely liable for the <br /> security and safety of the persons, and property of City parking <br /> patrons and customers using the parking garage. The City shal.l <br /> take such safeguards as may be deemed necessary to provide such <br /> security and safety. <br /> 8 . Separability. If any term, condition, covenant or <br /> provision of this Agreement or the application thereof to any <br /> party hereto or person or circumstance shall, to any extent, be <br /> invalid or unenforceable, the remainder of this Agreement or the <br /> application of such term or provision to persons or circumstances <br /> other than those to which it is held invalid or unenforceable <br /> shall not be affected thereby, and such terms, covenants, <br /> conditions and provisions of this Agreement shall be valid and be <br /> enforced to the fullest extent provided by law. <br /> 9. Entire Agreement of Parties . This Agreement constitutes <br /> the entire Agreement of the parties hereto with respect to the <br /> -12- <br />
