The City further acknowledges, <br /> understands and agrees that the present condition of the parking <br /> garage is not the result of any intentional or unintentional act <br /> on the part of the Authority but is due to age and natural <br /> deterioration as well as structural conditions inherent in the <br /> facility. <br />� (f) Release. To the extent provided by law, the City, in <br /> using the parking garage and the premises does so at its own <br /> risk. To the extent provided by law, the Authority shall not be <br /> liable for any damages to property sustained by the City or City <br /> parking patrons and customers in the parking garage or on the <br /> premises thereof, or any portion thereof. The City assumes full <br /> responsibility for any property damages or injuries which may <br /> occur to the City, its agents, contractors, employees, patrons, <br /> customers or guests in, resulting from or arising out of the <br /> City' s use of the parking garage or the premises thereof. The <br /> City does hereby fully and forever on its own behalf release and <br /> discharge the Authority and the Authority' s Board members, <br /> employees or agents, in both individual and official capacities, <br /> from any and all claims, demands, damages, rights of action or <br /> causes of action, present or future, whether the same be known, <br /> anticipated or unanticipated, whether due to negligence or the <br /> -7- <br />
