, <br /> � ����� <br /> w . . <br /> AMENDMENT N0. 1 <br /> TO AN AGREEMENT BETWEEN <br /> THE STATE OF ILLINOIS DEPARTMENT OF TRANSPORTATION <br /> AND <br /> THE CITY OF DECATUR <br /> (Contract No. 1614) <br /> PROJECT CAP-90-365-FED <br /> This Amendment No. 1 to an Agreement dated November 9, 1990 <br /> between the State of Illinois, Department of Transportation and <br /> the City of Decatur is made and entered into by and between the , <br /> parties thereto. In consideration of the mutual covenants <br /> contained herein and in such Agreement the Parties agree as <br /> follows: <br /> 1. To amend Part I - "Mass Transportation Capital Grant <br /> Agreement" by deleting ITEM 2, paragraph 1 and replacing it ', <br /> with the following: � <br /> ITEM 2 - AMOUNT OF GRANT i <br /> The Department agrees to make a Grant in an amount equal to I� <br /> 25 percent of the actual pro�ect cost of fuel injector systems, <br /> a diesel engine, and a fuel distribution system, or in the <br /> amount of $17,375, whichever is less. The actual pro,ject cost <br /> will be determined by the Department upon completion of the <br /> Project. The Department at its sole discretion may agree to <br /> increase the amount of the grant in excess of the amount <br /> specified herein in the event that the amount of the federal <br /> grant made in connection with this pro�ect is subsequently <br /> increased, but in no event shall the total amount provided by � <br /> the Department under this Agreement or any subsequent Amendment <br /> to this Agreement exceed 25 percent of the actual cost of fuel <br /> injector systems, a diesel engine, and a fuel distribution <br /> system. No liability shall be incurred by the State in excess <br /> of the amount of the Grant. <br /> The parties hereto agree that the Agreement dated November 9, <br /> 1990 between the Parties is in all other respects ratified and <br /> reaffirmed and that it continues in full force and effect as j <br /> hereby amended. �, <br />
