Highway Commissioner and preparation for the vacation and <br /> hearings thereon; attorney fees incurred by the Commissioner, <br /> provided however, the term "expense" shall not include any <br /> payment to the Commissioner for the time the Commissioner spends <br /> in connection with the vacation. <br /> 3 . Additional Payment. In addition to all other payment <br /> described in this Agreement, on or before 30 days from the date <br /> of the Final Order entered by the Highway Commissioner in the <br /> vacation of the subject roadway, the City shall pay to the Road <br /> District the sum of $7,500.00. <br /> 4. Survey and Plat. The Highway Commissioner shall not <br /> include in his expenses described above the cost of the <br /> preparation of a survey and plat of the subj ect roadway if, the <br /> � City furnishes to the Highway Commissioner before the Highway <br /> Commissioner files his certificate to vacate the subject roadway <br /> a survey and plat of the subject roadway made in accordance with <br /> §6-307 of the Highway Code. <br /> 5. Release of Damages . Prior to the public hearing held by <br /> the Commissioner upon the certificate for vacation of the public <br /> roadway, as required by §6-305 of the Highway Code, the City <br /> shall deliver to the Highway Commissioner a Release of Damages in ' <br /> the form as attached hereto as Exhibit Y.
