pertains to damages which might otherwise accrue to the City by <br /> reason of the vacation of the subject roadway and is obtained by <br /> the Commissioner pursuant to the terms of §6-308 and §6-309 of <br /> the Highway Code. <br /> 6. Road Maintenance and Damage._ During such time as the <br /> City owns real estate in §2 and §3, Township 16 North, Range 3 <br /> East of the 3rd P.M. , in the Town of Oakley, Macon County, <br /> Illinois, the City shall, in addition to all other obligations of <br /> the City stated in this Agreement, pay to the Road District, the <br /> cost sustained by the Road District for (a) damage to any road <br /> district roads, or (b) increase in maintenance cost to the roads <br /> in the Road District, caused by vehicles or equipment of the City <br /> (or agents of the City) using roads in the Road District <br /> servicing or working at the site of the City owned real estate <br /> located in said Road District. <br /> 7. Payment to Road Fund. All payments required to be made <br /> by the City as provided in this Agreement shall be payable to the <br /> Road District and shall be deposited in the road fund of the <br /> district. <br /> 8. Interest on Delinquency. If any expense or money owing <br /> by the City to the Road District under the terms of this <br /> Agreement is not paid within 30 calendar days from the date such <br /> -5- <br />
