r �• • � <br /> + , <br /> COST SHARING AGREEMENT <br /> between the <br /> CITY OF DECATUR, ILLINOIS _ <br /> and the <br /> STATE OF ILLINOIS/DEPARTMENT OF TRANSPORTATION <br /> for <br /> SPOIL SITE PREPARATION/LAKE DECATUR DREDGING <br /> THIS AGREEMENT made and dated this day of , 1991 <br /> between the city of Decatur , Illinois , hereinafter referred to as <br /> the "CITY" , and the Illinois Department of Transportation, <br /> acting for and on behalf of the State of Illinois , hereinafter <br /> referred to as the "DEPARTMENT" , <br /> WITNESSETH: <br /> WHEREAS , the DEPARTMENT and the CITY are legal entities <br /> organized and existing under the laws of the State of Illinois <br /> having among their powers the authority to contract with one another <br /> to perform such undertakings as described herein; and <br /> WHEREAS , the CITY is in the process of implementing a <br /> dredging project in Lake Decatur between the Norfolk & Western <br /> Railroad Bridge and Rea ' s E3ridge commonly referred as the Fairies <br /> Park Basin , which will improve the water supply for area residents I <br /> and businesses ; and <br /> WHEREAS, the Illinois General Assembly has appropriated the I' <br /> sum of $850 ,000 Capital Development Bond Funds to the DEPARTMENT <br /> under Section 56 of Public Act 86-1151 (House Bill 3462) , approved <br /> July 13 , 1990 , reappropriated under Section R74 of Public Act 87-60 <br /> (House Bill 376) , approved July 30 , 1991 , for dredging of Lake <br /> Decatur; and <br /> WHEREAS, the CITY has acquired the land rights for a spoil <br /> site to deposit dredged material to be taken from the lake bottom, <br /> and the DEPARTMENT is willing to participate in the costs for design <br /> plans and specifications and the necessary construction work <br /> required to prepare the site to accept the maximum amount of dredged <br /> material. <br /> NOW THEREFORE , for and in consideration of the benefits to <br /> be derived from the dredging of Lake Decatur , the sufficiency of <br /> which is hereby acknowledged , the parties hereto agree to the <br /> following terms and conditions : <br /> 1 . The recitals set forth above are incorporated herein <br /> by reference and made a part hereof , the same constituting the <br /> factual basis for this transaction. <br />
