The DEPARTMENT will not participate in any costs for any work covered under this agreement until after the effective date of this agreement and not until after the DEPARTMENT has given written approvals required herein. Any work accomplished prior to this time will be the sole responsibility of the CITY . 3 . The CITY will cause the final design plans and specifications needed for the site preparation work to be prepared . It is understood that the CITY has f�ired an engineering consultant to prepare the final design plans and specifications . The DEPARTMENT will participate in the costs for preparing the design plans and specifications based upon invoices furnished to the DEPARTMENT by the CITY and approved by the DEPARTMENT, and which have been incurred after the DEPARTMENT has reviewed and approved the engineering consultant contract . 4 . The CITY will provide all land rights for the spoil site . Prior to the CITY advertising for bids for the site preparation work, the CITY will furnish to the DEPARTMENT certification that the CITY owns sufficient land rights upon which state funding will be expended for the site preparation work. 5. The CITY will be responsible for obtaining all federal , state and local permits required to do the site preparation work . The DEPARTMENT ' s review and approval of the final design plans under the terms of this agreement does not relieve the CITY from obtaining any required DEPARTMENT permit . All required permits must be obtained by the CITY prior to the CITY advertising for bids . 6. The CITY will perform all necessary planning , consultation with applicable state agencies to satisfy all state environmental and other laws , rules and regulations prornulgated thereunder , and executive orders which apply due to the expenditure of state funds on the site preparation work , which includes the following : a) "Executive Order Number 7 (1985) " referring to Natural Areas under administrative jurisdiction of the Illinois Department of Conservation. b) The "Illinois Endangered Species Protection Act" (I11 . Rev . Stat . 1989 , ch. 8 , par. 331 et seq. ) , as amended , under the administrative jurisdiction of the Illinois Department of Conservation. c) The "Illinois State Agency Historic Resources Preservation Act" (I11. Rev. Stat . 1989 , ch. 127 , par . 133c21 et seq. ) , as amended , under the administrative jurisdiction of the Illinois Historic Preservation Agency . d) The "Interagency Wetland Policy Act" (Ill . Rev . Stat . 1989 , ch. 96 1/2 , par. 9701-1 et seq. ) , as amended , under the administrative jurisdiction of the Illinois Department of Conservation. -2-
