SCHWITEK, <br /> hereinafter referred to as Owner, and the CITY OF DECATUR, <br /> ILLINOIS, a Municipal Corporation, hereinafter referred to as <br /> Buyer, as follows: <br /> 1 . The Owner agrees to sell, and the Buyer agrees to <br /> purchase, the following described real estate (premises) situated <br /> in Macon County, Illinois: <br /> The East 38. 3 acres of Lot 2 of the North West 1/4 of <br /> Section 2, Township 16 North, Range 3 East of the 3rd <br /> P.M. , except, beginning at the North East Corner of the <br /> above described tract, thence West 412 1/2 feet, thence <br /> South 347 1/2 feet, thence East 412 1/2 feet, thence <br /> North 347 1/2 feet to the place of beginning. <br /> 2 . Title evidence, such as a commitment for an owner' s <br /> title insurance policy insuring against defects in the <br /> merchantability of title to the value of the purchase price, <br /> shall show that there are no financing statements on file <br /> affecting any personal property or fixtures included in the <br /> purchase. Title may be subject to coal and mineral rights if now <br /> reserved or conveyed of record, and to all easements and building <br /> and use restrictions now of record which do not restrict <br /> reasonable or intended use. Buyer shall promptly advise Owner of <br /> any claimed defects in title evidence to permit resolution before <br /> 1 <br />
