^ .. ' • � <br /> connection charges incurred and unpaid as of Settlement. <br /> 7 . Buyer shall be entitled to possession of Premises at <br /> 12 : 00 o' clock P.M. on November 1, 1991, subject to the rights of <br /> Owner' s tenant under an oral year to year lease. Owner shall be <br /> entitled to all crops harvested on or before the date of <br /> Possession. If the date of Possession is subsequent to the date <br /> of Settlement, then, for and in consideration of Buyer ' s ��, <br /> permitting Owners to so retain Possession, Owner hereby covenant <br /> and agree to indemnify and hold harmless Buyer from any and all <br /> losses, causes of action, damages or claims of any kind, whether <br /> for personal injury or property damage, accruing to Owner, or <br /> tenants of Owner, arising out of or related to Owner' s possession <br /> and use of the premises during said period. This covenant shall <br /> survive the deed, if applicable. <br /> 8 . Settlement shall be held on October 7 , 1991, at 2: 00 <br /> P.M. in the City of Decatur Legal Department, Third Floor, One <br /> Civic Center Plaza, Decatur, Illinois, or at such other time and <br /> place as is mutually agreeable to the Owner and Buyer. <br /> 9 . This Agreement is entered into by the parties in <br /> settlement of Buyer' s action against Owner for the taking of the <br /> premises pursuant to the Buyer' s right of eminent domain in Case <br /> No. 91-ED-2 now pending in the Circuit Court of Macon County, <br /> Illinois . <br /> 10 . The premises are sold in an "as is" condition and Buyer <br /> assumes any liability to Illinois Environmental Protection Agency <br /> 3 <br />
