<br />� WI-�REAS, the United States of America acting through the
<br /> Federal Bureau of Public Roads has established a policy to regu-
<br /> late or prohibit encroachments on highways constructed ,in part
<br /> , vrith Federal Ftiads; aad .
<br /> WHEREAS, the State of Illinois acting through the Depart-
<br /> ment of Public Wozks and Buildings has established a policy of
<br /> regulating or prohibiting encroachments on highways constructed in
<br /> part wi.th State funds or with State adninistered Fedraral funds; and
<br /> , WHERfiAS� the City of Decatur, Illinois� is by statute given
<br /> the power to xegulate the use of streets, prevent and remove en-
<br /> cznachments thereon and to regulate and prevent the use of streets
<br /> foz ceztain puzposes. "
<br /> NOW THSRHFORS� BB IT ORDiAINBD BY THB COUNC II. OF THS CI�Y
<br /> OF DBCATUR, ILLIN'OIS s
<br /> Section 1. No building, fence, sign, structure, object or
<br /> encroachment of any kind, except authorized traPfic signs and signals,
<br /> street lights, municipally owned parking meters and poles, lines,
<br /> sewezs, mains, pipes, tiles, coriduits, and appuztenances thereto, of
<br /> the City or of eorporations licensed or franchised by the C�ty for the
<br /> pnrpose of transnitting or distributing gas, electricity, messages or
<br /> signals, shall be hereafter placed, located or maintained in� on, under
<br /> or over any portion of any street designated a State highway or desig-
<br /> nated a Fedezal aid highway.
<br /> Section 2. Any such building, fence, sign� structure or ob-
<br /> ject existing in, on� under, or ovez any portion of any part of any
<br /> such street shall be forthwith removed.
<br /> Section 3. Awnings, marquees, signs and similar overhanging
<br /> structures existing at the date hereof supported solely from buildings
<br /> imnediately adjacent to any such street as aforesaid at a place thereon
<br /> � where there is a continuous sideavalk extending to and through the fzont-
<br /> age of the building line and which do not impair the free and safe flow
<br /> of traftic and do not hide from view or intezfere with the effectiveness
<br /> of any traffic contzol device or sign on such portion of any said street
<br /> may be pernitted to reaain, provided that the owner thereof shall obtain
<br /> a perait for the same fron the Huilding Inspector which said permit shall
<br /> be revocable at the discretion of the City and shall be issued only vrith
<br /> the approval of the Citq Engineer and the Department of Public Works and
<br /> Buildings of the State of Illinois.
