agre�ner►t or at law or in equity or by statute; provided, however, that if <br /> Contractor camiences curino or rgnedying a default within the ten day period <br /> but is unable to cure the default within the ten da,� period then the �eriod <br /> for cure of default shall Ue extended for the period of time reasonably <br /> necessary to cure the default. <br /> 13.2. In the event of a default herein by (;ontractor which is not cured <br /> or removed within the ten day period or extension thereof, the City shall have <br /> the right to: <br /> (a) Terminate this a�ree�nent b,� written notice to the Contractor, <br /> which termination shall be effective on the date specified iri such <br /> notice. <br /> (b) Suspend payment of all monies due or to becane due to C;ontractor <br /> under this agreement, provided, however, that said suspension of <br /> monies shall be subject to the curirig of the default only and sha11 <br /> not be treated as liquidated damages hereunder in the event a default <br /> is timely cured, otherwise suspended funds may be treated as <br /> liquidated damages pursuant to Subsection 13.3 hereof; <br /> (c) Exercise �ny other remedy granted by this agre�nent as to any <br /> specific default or violation set out in this agree�nent; <br /> (d) Take whatever lawful action including legal, equitable or <br /> achninistrative, and including mandatory injunetion and specific <br /> performance which may appear necessary or desirable to the City to <br /> collect any payments due under this agreanent, or to abate or prevent <br /> any such default, or to enforce performance and observance of any <br /> oblioation, agreement or covenant of Contractor under this agreement; <br /> 19 <br />
