. � <br /> (e) Exercise any and all r�nedies available under the bond delivered <br /> pursuant to Subsection 12.2 hereof, including, without limitation, <br /> recovery under the bond of any and all monies and dama�es due <br /> hereunder; <br /> (f) Kecover monetary damages suffered or incurred or to be suffered <br /> or incurred, by the (:it;� due to the default, even if the agreanent <br /> tias been terminated, cancelled or rescinded in whole or in part; and, <br /> I (g) Take whatever action is reyuired to cure the default, including, <br /> without limitation, paymerits to others, or performance for or on <br /> behalf of the Contractor of it covenants, obligations and agre�nents <br /> in this a reement. <br /> � <br /> In addition to the fore�oin� r�nedies, the City may take whatever <br /> reasonable and lawful steps it rnay de�n appropriate to preserve life or <br /> property or prevent accwnulation of recyclable materials or prevent waste, <br /> with or without notice havin� been given, provided however, that nothino <br /> herein contained shall be deemed to create any duty or obligation upon the <br /> City to take such steps and provided further that zhe Cit;� shall take no such <br /> steQs during a period of cure except as are necessary to preserve life or <br /> property. <br /> 13.3. The Cit� shall be entitled to colleet frorn Contractor all costs <br /> and expenses incurred b� the City in seekin� or exercisin� the r�nedies <br /> provided to the City pursuant to this Section XIII and in collecting any <br /> monies due the City frcxn Contractor under this agreement, including reasonable <br /> private attorney's fees, tobether with interest thereon at the rate of 9°� per <br /> anntun. <br /> 20 <br />
