Owner of any claimed defects in title evidence to permit <br /> resolution before settlement. <br /> 3. At settlement, Owner shall deliver to Buyer a Warranty <br /> sub 'ect onl to those matters to which the <br /> I Deed to the remises, � y <br /> P <br /> title may be subject as provided in paragraph (2) and conveying <br /> the benefits of all easements a urtenant of record existin <br /> PP g <br /> prior to the execution of this contract, if any, in such form and <br /> together with such documentation as shall be required for <br /> recording said deed. Owner shall also furnish Buyer at <br /> settlement all documentation necessary to protect Buyer from <br /> mechanics ' liens. <br /> 4 . Owner warrants that they own and hereby sell all <br /> fixtures and equipment on and attached to the premises. <br /> 5. The agreed purchase price of the property described <br /> herein is One Hundred Forty-seven Thousand Dollars ($147,000 . 00) . <br /> The Buyer shall make payment in full at the time of settlement. <br /> 6 . In the event that the Buyer pays more money, on a <br /> dollar-per-acre basis, to the owner of any other tract shown on <br /> Exhibit A hereto, whether through the exercise of the power of <br /> eminent domain or otherwise, the Buyer shall pay to the Owner the <br /> difference between such higher per-acre price and the purchase <br /> price herein provided, on a per-acre basis and for the number of <br /> acres purchased hereby. This covenant shall survive the deed. <br />
