! <br /> K <br /> ; . - <br /> AGREEMENT <br /> THIS Agreement , by and between the City of Decatur , Illinois <br /> ("City") and Soules Bird Repellent Company ("Soules") . <br /> For and in consideration of the mutual promise and obliga- <br /> tions made and assumed hereunder , the City and Soules agree as <br /> follows : <br /> 1 . Soules shall implement a bird removal program in the <br /> area bounded by the south side of Leafland on the north, the <br /> west side of Van Dyke on the east , the north side of View <br /> Street on the south, and the east side of Oakland on the <br /> west referred to here as the "Packard Area" . It would also <br /> include the first block of Packard west of Oakland to Hill . <br /> (See map included as Exhibit A) . <br /> 2 . Soules ' bird removal program shall be designed <br /> primarily for the removal of starlings and other birds <br /> designated as "pests" by the State of Illinois Department of <br /> Public Health. <br /> 3 . Soules agrees that chemical processes will not be used 'I <br /> in the elimination of birds . <br /> 4 . Soules agrees that should some birds (only starlings or I <br /> other birds defined as "pests" by the State of Illinois ' <br /> Department of Public Health) have to be killed with a pellet i <br /> gun or rifle , these birds will immediately be removed and <br /> disposed of in accordance with Federal, State and local law. <br /> 5 . Soules agrees to implement the bird removal program in <br /> the Packard area for period beginning on June 4 , 1991 and <br /> ending on May 31 , 1992 . <br /> 6 . Soules further agrees to decrease the population of I <br /> starlings and other birds defined as pests by the State of , <br /> Illinois Department of Public Health by 95� by September 1 , ' <br /> 1991 . The starling and "pest" bird population will be es- <br /> timated by Soules prior to July 1 , 1991 , and shall be ! <br /> verified at the discretion of the City , by whatever means I <br /> are available , and an estimated population shall be agreed ��, <br /> to by Soules and the City prior to implementation of the <br /> bird removal program. <br /> 7 . Soules further agrees that prior to any payment , the <br /> City shall survey residents of the Packard Area to ascertain <br /> whether or not the bird population has been significantly <br /> decreased . <br />
