. . ` VIII. EhVIRONMEh'TAL PROTECTION 1. The contractor stipulates that any faciiity to be utili2ed in the performance of this contract, unless such contract is exempt under the Clean Air Act, as amended (42 U.S.C. 1857 et seq. , as amended by Pub. L. �31-604) , Executive Order 11733, and regulations in implementa- tion thereof (40 CFR, Part 15), is not listed, on the date of contract award, on the U.S. Environmental Protection Agency (EPA) List of Violat- ing Facilities Pursuant to 40 CFR, 15.20. 2. The contractor agrees to comply with all the requirements of section 114 of the Clean Air Act, as amended, and section 308 of the Water Pollution Control Act, as amended, relating to inspection, monitoring, entry, reports, and information, as well as all other re- quirements specified in section 114 and all regulations and guidelines listed thereunder. 3. The contractor shall promptly notify the State Highway Depart- ment of the receipt of any communication from the Director, Office of Federal Activities, EPA, indicating that a facility to be utilized for contract is under consideration to be listed on the EPA List of Violat- ing Facilities. 4. The contractor agrees to include or cause to be included the requirements of subparagraphs 1 through 4 of this paragraph VIII in every nonexempt subcontract, and further agrees to take such action as the Government may direct as a means of enforcing such requirements. IX. CONTRACTING WITH SMALL AND MINORITY FIRMS, k'OMEN'S EUSINEJJ ENTERPRISES AND LAEOR SURPLUS AREA FIRMS It is national policy to award a fair share of contracts to small and minority business firms. Accordingly, affirmative steps must be taken to assure that small and minority businesses are utilized when possible as sources of sup- pliers, equipment, construction and services. Affirmative steps taken by the contractor shall include the following: 1. Including qualified small and minority businesses on solicitation lists. 2. �ssuring that small and minority businesses are solicited whenever they are potential sources. 3. When economically feasible, dividing total requirements into smaller tasks or quantities so as to permit maaimum small and minority business par- ticipation. 4. k'here the requirement permits, establishing delivery schedules which will encourage participation by small and minority business. 5. Using the services and assistance of the Small Eusiness Administra- tion, the Office of Minority Business Enterprise of the Department of Commerce and the Community Services Administration as required. 6. The contractor shall take similar appropriate affirmative action in support of women's business enterprises. 7. The contractor is encouraged to procure goods and services from labor surplus areas.
