. . <br /> ` VIII. EhVIRONMEh'TAL PROTECTION <br /> 1. The contractor stipulates that any faciiity to be utili2ed in <br /> the performance of this contract, unless such contract is exempt under <br /> the Clean Air Act, as amended (42 U.S.C. 1857 et seq. , as amended by <br /> Pub. L. �31-604) , Executive Order 11733, and regulations in implementa- <br /> tion thereof (40 CFR, Part 15), is not listed, on the date of contract <br /> award, on the U.S. Environmental Protection Agency (EPA) List of Violat- <br /> ing Facilities Pursuant to 40 CFR, 15.20. <br /> 2. The contractor agrees to comply with all the requirements of <br /> section 114 of the Clean Air Act, as amended, and section 308 of the <br /> Water Pollution Control Act, as amended, relating to inspection, <br /> monitoring, entry, reports, and information, as well as all other re- <br /> quirements specified in section 114 and all regulations and guidelines <br /> listed thereunder. <br /> 3. The contractor shall promptly notify the State Highway Depart- <br /> ment of the receipt of any communication from the Director, Office of <br /> Federal Activities, EPA, indicating that a facility to be utilized for <br /> contract is under consideration to be listed on the EPA List of Violat- <br /> ing Facilities. <br /> 4. The contractor agrees to include or cause to be included the <br /> requirements of subparagraphs 1 through 4 of this paragraph VIII in <br /> every nonexempt subcontract, and further agrees to take such action as <br /> the Government may direct as a means of enforcing such requirements. <br /> IX. CONTRACTING WITH SMALL AND MINORITY FIRMS, k'OMEN'S EUSINEJJ ENTERPRISES <br /> AND LAEOR SURPLUS AREA FIRMS <br /> It is national policy to award a fair share of contracts to small and minority <br /> business firms. Accordingly, affirmative steps must be taken to assure that <br /> small and minority businesses are utilized when possible as sources of sup- <br /> pliers, equipment, construction and services. Affirmative steps taken by the <br /> contractor shall include the following: <br /> 1. Including qualified small and minority businesses on solicitation <br /> lists. <br /> 2. �ssuring that small and minority businesses are solicited whenever <br /> they are potential sources. <br /> 3. When economically feasible, dividing total requirements into smaller <br /> tasks or quantities so as to permit maaimum small and minority business par- <br /> ticipation. <br /> 4. k'here the requirement permits, establishing delivery schedules which <br /> will encourage participation by small and minority business. <br /> 5. Using the services and assistance of the Small Eusiness Administra- <br /> tion, the Office of Minority Business Enterprise of the Department of Commerce <br /> and the Community Services Administration as required. <br /> 6. The contractor shall take similar appropriate affirmative action in <br /> support of women's business enterprises. <br /> 7. The contractor is encouraged to procure goods and services from <br /> labor surplus areas. <br />
