Any subcontractor of the ENGINEER shall be required to <br /> procure and maintain Insurance the same as required of the <br /> ENGINEER and to comply with the provisions hereof, including <br /> the furnishing of certificates of Insurance to the OWNER. <br /> ENGINEER agrees that the Comprehensive General Liability, both <br /> bodily Injury and Property Damage, and the Architects and <br /> Engineers Professional Liability Insurance coverage for this <br /> project shall remain in full force and effect for one year <br /> after the completion of this Contract. <br /> B. THE PUBLIC AGENCY AGREES, <br /> l . To pay for the services enumerated above under "The Engineer Agrees" <br /> at the hourly rates stipulated below for personnel assigned to this <br /> work as payment in full to the Engineer for the actual time spent in <br /> providing these services - the hourly rates to include profit, over- <br /> head, readiness to serve, insurance, social security, and retirement <br /> deductions. Reimbursement for transportation furnished the Resident <br /> Engineer shall be at the rate of One Hundred Eighty Dollars ($180.00) <br /> per month or Twelve Dollars ($12.00) per day for any fraction of a <br /> calendar month. Other travel and out-of-pocket expenses will be <br /> reimbursed to the Engineer at his actual cost. Subject to the approval <br /> of the Public Agency, the Engineer may sublet all or part of the <br /> services provided under paragraph lb. <br /> Classification Per Hour Rates <br /> Principal $ 70.00 <br /> Project Engineer 40.00 <br /> Engineer Tech. IT IS MUTUALLY AGREED, , <br /> l . That any difference between the Engineer and the Public Agency con- <br /> cerning the interpretation of the provisions of this agreement shall <br /> be referred to a committee of disinterested parties consisting of <br /> one member appointed by the Engineer, and one member appointed by the <br /> Public Agency and a third member appointed by the two other members <br /> for disposition and that the committee's decision shall be final . <br /> 2. This agreement may be terminated by the Public Agency upon giving <br /> notice in writing to the Engineer at his last known post office <br /> address Upon such termination, the Engineer shall cause to be delivered <br /> to the Public Agency all drawings, specifications, partial and com- , <br /> pleted estimates, and data, if any from traffic studies and soil survey <br /> and subsurface investigations with the understanding that all such <br /> material becomes the property of the Public Agency. <br />
