Any subcontractor of the ENGINEER shall be required to procure and maintain Insurance the same as required of the ENGINEER and to comply with the provisions hereof, including the furnishing of certificates of Insurance to the OWNER. ENGINEER agrees that the Comprehensive General Liability, both bodily Injury and Property Damage, and the Architects and Engineers Professional Liability Insurance coverage for this project shall remain in full force and effect for one year after the completion of this Contract. B. THE PUBLIC AGENCY AGREES, l . To pay for the services enumerated above under "The Engineer Agrees" at the hourly rates stipulated below for personnel assigned to this work as payment in full to the Engineer for the actual time spent in providing these services - the hourly rates to include profit, over- head, readiness to serve, insurance, social security, and retirement deductions. Reimbursement for transportation furnished the Resident Engineer shall be at the rate of One Hundred Eighty Dollars ($180.00) per month or Twelve Dollars ($12.00) per day for any fraction of a calendar month. Other travel and out-of-pocket expenses will be reimbursed to the Engineer at his actual cost. Subject to the approval of the Public Agency, the Engineer may sublet all or part of the services provided under paragraph lb. That any difference between the Engineer and the Public Agency con- cerning the interpretation of the provisions of this agreement shall be referred to a committee of disinterested parties consisting of one member appointed by the Engineer, and one member appointed by the Public Agency and a third member appointed by the two other members for disposition and that the committee's decision shall be final . 2. This agreement may be terminated by the Public Agency upon giving notice in writing to the Engineer at his last known post office address Upon such termination, the Engineer shall cause to be delivered to the Public Agency all drawings, specifications, partial and com- , pleted estimates, and data, if any from traffic studies and soil survey and subsurface investigations with the understanding that all such material becomes the property of the Public Agency.
