� . � ' � <br /> AGREEMENT <br /> This Agreement is entered into by and between the State of Illinois, <br /> acting through its Department of Transportation, hereinafter referred to as <br /> the STATE, Macon County of the State of Illinois, hereinafter referred to as <br /> the COUNTY, and the City of Decatur of the State of Illinois, hereinafter <br /> referred to as the CITY. <br /> WITNESSETH <br /> WHEREAS, the parties hereto, in order to facilitate the free flow of <br /> traffic and insure safety to the motoring public, are desirous of performing <br /> . Phase II preliminary engineering, land acquisition, and utility adjustments <br /> on County Highway 1 (Brush College Road) from Illinois Route 48 to south of <br /> Faries Parkway and constructing a five-lane cross section on C.H. 1 (Brush <br /> College Road) from Brennaman Avenue to south of Faries Parkway to include <br /> intersection improvements at Brennaman Avenue and Faries Parkway and <br /> relocation of the I.C. Railroad at the Faries Parkway intersection. Said <br /> improvement to be identified as COUNTY Section 90-00119-00-PV and STATE Job <br /> Number C-95-006-91 and herein referred to as the PROJECT, and <br /> WHEREAS, the parties hereto are desirous of said PROJECT in that same <br /> will be of immediate benefit to the residents of the area and permanent in <br /> nature. <br /> NOW, THEREFORE, in consideration of the mutual covenants contained <br /> herein, the parties hereto agree as f�llows: <br /> 1 ) It is mutually agreed that the PROJECT will be designed, let and <br /> constructed in accordance with Motor Fuel Tax standards, policies and <br /> procedures. <br /> 2) The COUNTY agrees to make or cause to be made all surveys; prepare or <br /> cause to be prepared the plans, specifications, and estimates; and let <br /> and award the contract; provide engineering inspection during <br /> construction; and cause the improvement to be constructed in accordance <br /> with the plans, specifications, and contract "subject to partial <br /> reimbursement from the STATE and the CITY. <br /> 3) The COUNTY agrees to retain jurisdiction and maintenance of the <br /> completed PROJECT. <br /> 4) The COUNTY agrees to acquire all necessary right-of-way in accordance <br /> with Motor Fuel Tax Policy and Procedure prior to advertising the <br /> PROJECT for letting subject to partial reimbursement by the STATE and <br /> the CITY. <br />�,-:�.. _- .,: - . � -. _, . . . , <br />
