' ,r � . • AGREEMENT FOR ENGINEERING SERVICES THIS AGREEMENT, made this third day of May, 1990 by and between The City of Decatur, Illinois 62523, #1 Civic Center Plaza, Decatur, Illinois, hereafter referred to as the OWNER, and Tank Industry Consultants, Inc. , 4912 West 16th Street, PO Box 24359, Speedway, Indiana 46224, hereafter referred to as the ENGINEER. The OWNER intends to perform miscellaneous repairs and repainting of two elevated water storage tanks. The ENGINEER agrees to perform resident inspection services and perform various professional services related to the projects for two years from the execution of this contract. WITNESSETH: That for and in consideration of the mutual covenants and promises between the parties hereto, it is hereby agreed: SECTION I - ENGINEERING SERVICES The ENGINEER agrees to perform professional services for the OWNER on an as-needed basis, at the discretion of the OWNER: A. WORK IN PROCESS INSPECTION 1. The ENGINEER will provide inspection of the work only if engaged for detailed construction inspection and compensated for this detailed construction inspection as set forth in Section IV, Paragraph 2. 2 . The duties of the inspector shall be: a. Conduct on-site observation of the Work in progress to assist the OWNER in determining if the work is in general proceeding in accordance with the Contract Documents. b. Report to OWNER whenever inspector believes that any Work is unsatisfactory or defective or does not conform to the Contract Documents, or has been damaged, or does not meet the requirements of any inspection, test or approval required to be made; and advise OWNER of Work that inspector believes should be corrected or rejected or should be uncovered for observation, or requires special testing, inspection or approval.
