' � � successurs n►ay use said strip of ground for driveway, parking area, �rowing <br /> crops, fence or lawn improvements, as long as such use does not pronibit, <br /> � damage, or unreasonably interfere with, the use and purpose of said <br /> easement, or access by the District for its use and purposes. <br /> Z. The District shall have the right and obl�gation to restore the <br /> surface of that part ot the groperty herein described used for construction <br /> purposes, to its original grade, and to re-seed any disturbed areas which <br /> were used as lawns at the time of this deed. <br /> 3. Any fence or other improvement not inconsistent with th�s easement <br /> which was located on the area covered by this easement, but which is moved <br /> or disturbed during construction, shall be restored as nearly as possible <br /> to its condition immediately prior to construction, at the axpense of the <br /> District. <br /> 4. The District shail make reasonable etfort to preserve any tre�s, <br /> shrubbery, or other items of landscaping during construction, out the <br /> District shall have the right to remove, without obligation to rep�ace, <br /> trees and shrubbery within the area covered by the permanent easement winere <br /> such removal is reasonably necessary to the economical construction, <br /> reconstruction or repair of the sewer and for the access of equipment. <br /> 5. Said sewer or sewers and all facilities used or useful in <br /> connection therewith shall be installed and maintained at District's sole <br /> risk and axpense, with due diligence and in a workmanlike manner, and <br /> District shall indemnify and save Grantor(s) harmless from any loss, damage, <br /> or injury to person or property arising out or District's operations <br /> hereunder, except such as may directly result from the negligence of <br /> Grantor(s) . <br /> 6. The Grantor(s) or his, her, their, or its successors in title <br /> shall have no right to connect to said sewer without the prior written <br /> consent of the District. <br /> 7. The temporary construction easement shall terminate upon <br /> completion or acceptance by the District of said improvements. <br /> 8. This Agreement contains a11 the terms and conditiens agreed upon <br /> by tne parties and no other Agreements, oral or otherwise, shall be �.eemed <br /> to exist. <br /> 9. �estitution has been received for the =ollowing damages: <br /> The Grantor(s) hereby release and waive all rights under and by virtue <br /> of the Homestead Exemption Laws of the State of Illinois. <br /> Dated this 18thday of December , A.D. , 1�' 89 . <br /> Sheet Z of 4 Sheets <br /> L <br />
