• 3. That the City expressly agrees: <br /> A. The �ity shall provide verification of the legal description <br /> of each leased tract, by a �icensed surveyor approved by the District, <br /> as a condition precedent to drilling any production weil . <br /> B. P,ny welis constructed shall be operated in a manner such <br /> as not to interfere with other municipal or private wells or water <br /> systems. <br /> C. The construction, operation and maintenance of any and <br /> all such wells, and also ingress and_egress� thereto,..together with any <br /> pum�s� distribution2 .equipment, control or power .apparatus, and any.and •" <br /> all other attendant equipment or facilities, shall be done in such manner <br /> as to mitigate the impact on District land to the greates extent possible; ' <br /> such equipment and facilities shall be located underground except for <br /> control boxes, well heads, and any other appurtenances necessary for the " <br /> pumping operations with the physical elements being subject to the ap- <br /> proval of the District. <br /> D. Any wei7 constructed shall be operated only as an emergency, <br /> aiternate water supply to alleviate water shortages. Such a shortag� <br /> shall be deemed to occur when each of the following conditions are met: <br /> (i ) When the Illinois State Water Survey's measuring <br /> station at Monticello, Illinois registers the flow of the <br /> Sangamon River at a rate of less than twice the daily peak treat- <br /> ment capacity; � <br /> (According to the Illinois �ater Survey, the watershed <br /> above Lake Decatur and below Monticello's gaging station <br /> contributes sufficient water on average that the <br /> flow into the north end of Lake Decatur is 1 .68 times <br /> �he flow at Morticello. �hen n�nety cubic feet per <br /> second flow past Monticello, about 98,00O,OOQ galions <br /> of water flow into Lake Decatur, more than twice the <br /> current �eak treatment capacity. ) and <br /> (ii ) When the level of Lake Decatur shall fail below <br /> either of the follo�ving ievels: � <br /> (a) PJovember 1 to March 30 -- 612 feet <br /> above sea level ; <br /> (b) April 1 to October _31 -- 614 feet � <br /> above sea level . � � <br /> E. The City shall restore any leased or other District property <br /> affected pursuant to the construction, operation or maintenance of any test <br /> or other well , to the satisfaction of the District. <br /> 4. That it is mutually understood by the parties hereto that <br /> any power, right, responsibility or obligation created by this agreement <br /> or by the lease(s) contemplated hereby shall be subject to the temporary <br /> restraining order entered January 4, 1989 and amended January i2, 1989 <br />
