• , �T - <br /> Section 105. Requisitions and Payments. <br /> a. Requests for Payment by the Recipient. The Recipient may make <br /> requests for payment of the Federal share of allowable costs, and <br /> the Government (UMTA) will honor such `requests in the manner set <br /> forth in this Section. Payments made to the Recipient must comply <br /> with 31 C.F.R. Part 205. In order to receive Federal assistance <br /> payments, the Recipient must: <br /> (1) Completely execute and submit to the Government (UMTA) <br /> the information required by Standard Form 270; , <br /> (2) Submit to the Government (UMTA) an explanation of the <br /> purposes for which costs have been incurred to date or are <br /> reasonably expected to be incurred within the requisition period <br /> (not more than 30 days after the date of submission) ; <br /> (3) Demonstrate or certify that it has supplied local funds <br /> adequate, when combined with the Federal payments, to cover all <br /> costs to be incurred to the end of the requisition period; <br /> (4) Have submitted to the Government (UMTA) all financial <br /> and progress reports required to date under this Agreement; and <br /> (5) Identify the source(s) of financial assistance provided <br /> under this Project from which the payment is to be derived. <br /> b. Payment by the Government. Upon receipt of the requisition <br /> and the accompanying information in satisfactory form, the <br /> Government will process the requisition if the Recipient is <br /> complying with its obligations pursuant to the Agreement, has <br /> satisfied the Government of its need for the Federal funds <br /> requested during the requisition period, and is making adequate <br /> progress towards the timely completion of the Project. If all of <br /> these circumstances are found to exist, the Government may <br /> reimburse apparent allowable costs incurred (or to be incurred <br /> during the requisition period) by the Recipient up to the maximum <br /> amount of Federal assistance payable through the fiscal year in <br /> which the requisition is submitted as stated in the Pro�ect <br /> Budget. However, reimbursement of any cost pursuant to this <br /> section shall not constitute a final detenaination by the <br /> Government of the allowability of such cost and shall not <br /> constitute a waiver of any violation of the terms of this <br /> Agreement committed by the Recipient. The Government will make a <br /> final determination of allowability only after an audit of the <br /> Project has been conducted. If the Government determines that the <br /> Recipient is not eligible to receive any or all of the Federal <br /> funds requested, the Government will notify the Recipient stating <br /> the reasons therefor. Unless prohibited by law, the Government <br /> may offset any Federal assistance funds to be made available under <br /> this Project as may be necessary to satisfy any monetary claims <br /> that the Government may have outstanding against the Recipient. <br /> Page 6 <br />
