2. 3. Promptness of Maintenance, Re airs and Re lacement <br /> All maintenance, repairs and replacement required to be made by <br /> either the Authority or the City shall be made promptly so that <br /> the monument site is properly maintained and does not detract <br /> from the Civic Center Complex or the mall area in which it <br /> exists. � <br /> 2. 4. Utilitv Services. Any utilities used by the City on <br /> the premises shall be at the cost of the City. <br /> ARTICLE III <br /> LIABILITY AND INSURANCE <br /> 3 . 1. Liability. To the extent provided by law, the City, <br /> in using the premises , does so at its own risk . The Authority , <br /> shall not be liable for any damages to property or damages I <br /> arising from personal injuries sustained by any user of the <br /> premises including, but not limited to, the City and its agents, <br /> contractors, employees, visitors, guests, patrons, invitees or <br /> trespassers . The City assumes full responsibility for any <br /> property damages , or injuries which may occur to any of the <br /> aforedescribed persons arising out of the use of the premises by <br /> any person, whether described above and included as a user or not <br /> and whether the damage sustained is property damage or bodily or <br /> personal injury or death . <br /> 3. 2. Indemnification. To the extent provided by law, the <br /> City shall indemnify and hold harmless the Authority from all <br /> claims for property damage or for bodily injury or death arising <br /> -4- <br />
