out of the use of, or any work or thing whatsoever done in or <br /> about the premises or structures or equipment thereon, or arising <br /> out of the condition of any portion or all of the premises and <br /> whether such damage or injury or death occurs to any person who <br /> is using the premises for any purpose and under any <br /> circumstances, including but not limited to, the City and its <br /> agents, contractors, employees, visitors, guests, invitees, <br /> patrons or trespassers, whether due to negligence or otherwise, <br /> and such indemnification and holding harmless shall be from all <br /> costs, demands, damages , suits, losses, attorney fees and <br /> liabilities incurred in or about such claim for property damage <br /> or bodily injury or death or any action or proceeding brought ' <br /> thereon. �I <br /> 3. 3. Structural Work Act . Article III of this Agreement <br /> shall apply, but not be limited to, all claims and judgments <br /> arising under or as a result of or alleged to arise under or as a <br /> result of the Illinois Laws regarding Structural Work (I11 . Rev. <br /> Stat. 1987 , Ch. 48, §60 et seQ. ) . <br /> 3. 4. Definition of Authoritv. As used in Article III of <br /> this Agreement, the word "Authority" shall mean and include not <br /> only the unit of local government which is a party to this <br /> Agreement but shall also include the Board members, employees or <br /> agents, in both their respective individual and official <br /> capacities. <br /> -5- <br />
