Excerpts from City Council Minutes of May 5, 1994 <br /> Cal. No. 94-42 Petition of STEVEN BORCHERS to rezone a tract <br /> of land located at the northeast corner of <br /> S.B.I. Route 48 and Southside Drive from R-1 <br /> Single Family Residence District to B-1 <br /> Neighborhood Shopping District. <br /> Mr. Richard Heavner, Attorney, was present and spoke for the <br /> petition representing Bath, Inc. , of which Mr. Borchers is the <br /> president. The request is regarding property at the intersection <br /> of Routes 48 and 105 (Borchers Corner) and the rezoning request <br /> is only concerned with Lot 1 of the larger tract owned by Bath, <br /> Inc. The larger tract is to be annexed by the City of Decatur. <br /> Mr. McQueen presented the recommendation of staff: <br /> The subject petition requests that premises at the northeast <br /> corner of South Side Drive and Route 48 be rezoned from R-1 <br /> Single k'amily Residence District to B-1 Neighborhood Shopping <br /> District. Containing approximately one acre, the area in <br /> question is presently vacant and located outside the corporate <br /> limits of the City of Decatur; it is zoned B-2 under Macon County <br /> Zoning. A pre-annexation agreement has been filed with the City <br /> � Clerk requesting annexation of this parcel and an adjoining seven <br /> acres. The proposed B-1 classification for this tract is a part <br /> of said annexation agreement. <br /> Property to the west across Route 48 is presently zoned M-1 Light <br /> Industrial with B-2 zoning being located to the south across <br /> Southside Drive. Property located within the corporate limits to <br /> the east is zoned M-1 Light Industrial. The land use plan <br /> reflects commercial development for the area in question. <br /> Staff is of the opinion that the proposed zone is in keeping with <br /> the existing zoning patterns as noted. Further, we anticipate <br /> future requests to further extend commercial zoning eastward <br /> along Southside Drive as development plans materialize. <br /> In view of the above data, staff recommends approval of the <br /> petition as presented. <br /> Mr. Demirjian questioned the County zoning of this property. Mr. <br /> McQueen stated that it is zoned B-2 under County designation. <br /> It was moved and seconded (Hunt/Kaptain) to forward Cal. No. <br /> 94-42 to City Council with recommendation for approval. Motion <br /> carried unanimously. <br />
