,l
Excerpts from City Plan Commission Minutes of October 6, 1994
Ca1. No. 94-70 Petition of GARY E. SCHLOSSER to rezone the premises commonly
known as 3709 West Wood Street from R-1 Single Family Residence
District to R-2 Single Family Residence District.
Mr. Gary Schlosser, 3709 West Wood Street, was present and spoke for the petition stating his
request to rezone the lot so that part of it can be sold to his neighbor.
There were no objectors present.
Mr. McQueen presented the recommendation of staff:
The subject petition requests that premises commonly known as 3709 West Wood Street be
rezoned from R-1 Single Family Residence District to R-2 Single Family Residence District.
Containing 34,200 square feet, the lot in question is presently developed with one single family
dwelling. The purpose of the proposed zone is(1)to enable sale of a portion of the lot to an
adjoining owner and (2)to create a second buildable lot.
The area in question was annexed to the City of Decatur in 191, and in accordance with
applicable provisions of the Zoning Ordinance was classified in the R-1 Single Family District,
which requires a minimum lot area of 20,000 square feet. The proposed R-2 zone requires a
minimum area of 9000 square feet. While several lots in this subdivision were originally platted as
tracts containing 34,000 square feet, there have been previous divisions prior to annexation which
resulted in tracts as small as 5600 square feet. Also, property to the immediate north was rezoned
to R-2 Single Family in 1991.
Recognizing existing development and lot size in the general neighborhood and the existing R-2
zone as noted, staff is of the opinion the proposed zone would be compatible with the same. Both
City water and sanitary sewer services are available to serve this tract. As City utilities, namely
sanitary sewer become available, it is not uncommon for property owners to request zoning
changes for smaller lots. The proposed lot sizes in this case would be in keeping with several
areas of newer development within the corporate limits.
Staff recommends approval of the petition as presented.
It was moved and seconded (Fisher/Patterson)to forward Cal. No. 94-70 to City Council with
recommendation for approval as presented. Motion carried unanimously.
