COMMLJNITY DEVELOPMENT MEMORANDUM
NO. 94-208
October 11, 1994
TO: Honorable Mayor Erik C. Brechnitz and
City Council Members
FROM: 7ames C. Bacon, 7r., City Manager
George C. Weaver, Director of Community Development
Robert A. McQueen, Planner
SUBJECT: Ordinance to rezone 3709 West Wood Street
The subject petition requests that premises commonly known as 3709 West Wood Street be
rezoned from R-1 Single Family Residence District to R-2 Single Family Residence District.
Containing 34,200 square feet, the lot in question is presently developed with one single family
dwelling. The purpose ofthe proposed zone is(1)to enable sale of a portion ofthe lot to an
adjoining owner and(2)to create a second buildable lot.
The area in question was annexed to the City of Decatur in 1971, and in accordance with
applicable provisions of the Zoning Ordinance was classified in the R-1 Single Family District,
which requires a minimum lot area of 20,000 square feet. The proposed R-2 zone requires a '
minimum azea of 9000 square feet. While severallots in this subdivision were originally platted as
tracts containing 34,000 square feet, there have been previous divisions prior to annexation which '
resulted in tracts as sma11 as 5600 square feet. Also, property to the immediate north was rezoned
to R-2 Single Family in 1991.
Recognizing existing development and lot size in the general neighborhood and the eacisting R-2
zone as noted, staff is of the opinion the proposed zone would be compatible with the same. Both
City water and sanitary sewer services are available to serve this tract. As City utilities, namely
sanitary sewer become available, it is not uncommon for property owners to request zoning
changes for smaller lots. The proposed lot sizes in this case would be in keeping with several
areas of newer development within the corporate limits.
Staff recommends approval of the petition as presented.
