. `. <br /> ORDINANCE NO. � � -�� <br /> ORDINANCE GRANTING SPECIAL PERMIT <br /> PLANNED UNIT DEVELOPMENT <br /> - SOUTHEAST QUADRANT OF ROUTE 51 NORTH <br /> AND INTERSTATE ROUTE 72 - <br /> WHEREAS, on the Sth day of April, 1994, upon due notice, the Decatur City Plan <br /> Commission held a public hearing upon the petition of Hickory Point Apartments, L.P. for a <br /> special use permit for a R-6 Planned Unit Development on premises situated in the City of <br /> Decatur, Illinois, and described as follows: <br /> All that part of the West One Half (W 1/2) of the Southwest <br /> QuaRher (SW 1/4) of Section 23, Township 17 North, Range Two <br /> East of the Third Principal Meridian lying South of the right-of-way <br /> line for F.A.I. Route 72; and, <br /> WHEREAS, said Decatur City Plan Commission did report its findings and did <br /> recommend that said petition be granted. <br /> NOW, THEREFORE, BE IT ORDAIl�ED, BY THE CITY COUNCIL OF THE CITY <br /> OF DECATUR, ILLINOIS: <br /> Section 1. That the report and recommendation of the Decatur City Plan Commission be <br /> received, placed on file and approved. <br /> Section 2. That upon the conditions hereinafter mentioned, a special use permit be, and it <br /> is hereby granted to Hickory Point Apartments, L.P. to develop the premises descr�bed above <br /> under a R-6 Planned Unit Development in accordance with the plat and plans hereto attached, , <br /> marked Exhibit A and hereby made a part hereof. , <br /> Section 3. That said pernut be, and the same is hereby, expressly conditioned as follows: � <br /> (a) That the development be in accordance with petitioner's I� <br /> site plans labeled as sheets A-1, A-6 and L-l; ' <br /> (b) That watermains within the development and easements <br /> for the same be dedicated to the City of Decatur; <br />
