ORDINANCE NO. � � -�� ORDINANCE GRANTING SPECIAL PERMIT PLANNED UNIT DEVELOPMENT - SOUTHEAST QUADRANT OF ROUTE 51 NORTH AND INTERSTATE ROUTE 72 - WHEREAS, on the Sth day of April, 1994, upon due notice, the Decatur City Plan Commission held a public hearing upon the petition of Hickory Point Apartments, L.P. for a special use permit for a R-6 Planned Unit Development on premises situated in the City of Decatur, Illinois, and described as follows: All that part of the West One Half (W 1/2) of the Southwest QuaRher (SW 1/4) of Section 23, Township 17 North, Range Two East of the Third Principal Meridian lying South of the right-of-way line for F.A.I. Route 72; and, WHEREAS, said Decatur City Plan Commission did report its findings and did recommend that said petition be granted. NOW, THEREFORE, BE IT ORDAIl�ED, BY THE CITY COUNCIL OF THE CITY OF DECATUR, ILLINOIS: Section 1. That the report and recommendation of the Decatur City Plan Commission be received, placed on file and approved. Section 2. That upon the conditions hereinafter mentioned, a special use permit be, and it is hereby granted to Hickory Point Apartments, L.P. to develop the premises descr�bed above under a R-6 Planned Unit Development in accordance with the plat and plans hereto attached, , marked Exhibit A and hereby made a part hereof. , Section 3. That said pernut be, and the same is hereby, expressly conditioned as follows: � (a) That the development be in accordance with petitioner's I� site plans labeled as sheets A-1, A-6 and L-l; ' (b) That watermains within the development and easements for the same be dedicated to the City of Decatur;
