a { <br /> R • <br /> �" y , ' <br /> CHAPTER 28 <br /> UNLAWFUL DISCRIMINATION <br /> Article 1. POLICY/GENERAL DEFINITIONS. <br /> Section 1-l. It is hereby declared to be the policy of the <br /> City of Decatur in the exercise of its home rule powers to <br /> prohibit unfair public contract practices, unfair employment <br /> practices, unfair financial credit practices, unfair housing <br /> practices, unequal public places of accommodation practices, and <br /> noncompliance with the City' s affirmative action program as <br /> hereinafter defined. <br /> Section 1-2 . For the purposes of this Chapter, the <br /> following definitions shall apply unless the context indicates or <br /> requires a different meaning: <br /> (A) "Age" means the chronological age of a person who is at <br /> least 40 years old, except with regard to any practice described <br /> in Article 6 , insofar as that practice concerns training or <br /> apprenticeship programs . In the case of training or <br /> apprenticeship programs, for the purposes of Article 6 , "age" <br /> means the chronological age of a person who is 18 but not yet 40 <br /> years old. <br /> (B) "Charge" means an allegation filed with the Human <br /> Relations Officer by an aggrieved party, pursuant to Article 4 . <br /> (C) "Commission" means the Human Relations Commission <br /> created by this Chapter. <br /> (D) "Complaint" means the formal pleadinq filed by the <br /> Human Relations Officer with the Commission, following an <br /> investigation and finding of substantial evidence of a human <br /> rights violation , or the formal pleading filed with the <br /> Commission by an aggrieved party pursuant to Article 4 . <br /> (E) "Handicap" means a determinable physical or mental <br /> characteristic of a person, including, but not limited to, a <br /> determinable physical characteristic which necessitates the <br /> person's use of a guide, hearing or support dog, the history of <br /> such characteristic, or the perception of such characteristic by <br /> the person complained against, which may result from disease, <br /> injury, congenital condition of birth or functional disorder and <br /> which characteristic: <br /> (1) For purposes of Article 6 is unrelated to the <br /> person's ability to perform the duties of a particular <br /> job or position; <br /> 1 <br />
