► • Y <br /> : � <br /> ORDINANCE NO. �� � I <br /> ORDINANCE AMENDING SPECIAL USE PERMIT <br /> - M-2 EXTRACTIVE USE - <br /> - SOUTHSIDE DRIVE - <br /> WHEREAS, on the 5th day of August, 1993 , upon due notice, <br /> the Decatur City Plan Commission held a public hearing upon the <br /> petition of Vulcan Materials Company, owner of the premises <br /> described herein on Exhibit A hereto, to amend and modify a <br /> special use permit for the extraction of sand and gravel granted <br /> by Ordinance No. 5991, and subsequently amended by Ordinance Nos. <br /> 87-115, 88-101 and 92-62; and, <br /> WHEREAS, said Decatur City Plan Commission did report its <br /> findings and did recommend that the modification of said special <br /> use permit as required be authorized. <br /> NOW, THEREFORE, BE IT ORDAINED, BY THE CITY COUNCIL OF THE �' <br /> CITY OF DECATUR, ILLINOIS: <br /> Section 1. That the report and recommendation of the <br /> Decatur City Plan Commission be, and the same are hereby, <br /> received, placed on file and approved. <br /> Section 2 . That said Ordinance No. 92-62 be, and the same <br /> is hereby modified and amended by substituting Exhibits B and C <br /> attached hereto and hereby made a part hereof, for and in lieu of <br /> Exhibits B and C, respectively, of said Ordinance No. 92-62, for <br /> the purpose of said former Exhibits as therein expressed. <br /> Section 3 . That except as modified by the provisions <br /> hereof, the special use permit heretofore granted by Ordinance <br /> No. 5991 and subsequently amended by Ordinance Nos. 87-115, <br /> 88-101 and 92-62 remains in full force and effect, and the same <br /> remains subject to all the conditions , limitations and <br /> restrictions set out in the ordinance aforesaid, as amended <br /> hereby. <br /> PRESENTED, PASSED, APPROVED AND RECORDED this 7th day of <br /> September, 1993 . <br /> � <br /> C�fi1L� ..�,-� /` <br /> ERIK C.
