No. 93-51 be <br /> recommended to City Council for approval. Motion carried <br /> unanimously. <br /> Cal. No. 93-52 Final Plat - Spring Creek Estates <br /> Mr. Phillip Cochran, Consulting Engineer, was present and spoke <br /> for the petition stating that the preliminary plat was approved <br /> by City Council in July of this year. This will be a 30 lot <br /> subdivision. While it is not shown, the developer has agreed to <br /> construct a sidewalk from the south end of the cul-de-sac to the <br /> south property line. <br /> There were no objectors present. <br /> Mr. McQueen stated that staff recommends approval of the petition <br /> with the additional sidewalk as noted by petitioner. <br /> • It was moved and seconded (Coulter/Gruenewald) that Cal. No. <br /> 93-52 be recommended to City Council for approval per staff <br /> recommendation. Motion carried unanimously. <br /> Cal. No. 93-53 Petition of VLTLCAN MATERIALS COMPANY to amend <br /> and expand a special use permit granted by <br /> Ordinance #5991 and subsequently amended to <br /> allow extraction of sand and gravel on <br /> tracts of land generally located north of <br /> the 900 block Southside Drive and west of <br /> the 1100 block South Monroe Street. <br /> Mr. Daniel Roadruck, representative of Vulcan Materials Company, <br /> was present and spoke for the petition stating the request to <br /> amend the ordinance to mine gravel in the subject area. Vulcan <br /> was granted permission to mine a year ago but the City of Decatur <br /> wants that particular area for a sludge lagoon. Vulcan is <br /> requesting permission to mine another area, therefore, the <br /> petition is submitted to allow mining and expand the operation to <br /> the west with the 200 foot setback reduced to 50 feet. Mr. <br /> Roadruck stated that there was an error in the legal description <br /> for the area where the lagoon is located so that part of the <br /> petition is withdrawn at this time. The request for today is to <br /> revise the site plan and reduce the west setback. The office <br /> • will be relocated and timing is of the utmost importance. Mr. <br />
