. Decatur City Plan Commission <br /> August 5, 1993 <br /> Page Eight <br /> Roadruck stated that the lagoon is presently full of sludge and <br /> water. It will be mined in the next operating season and when <br /> finished, the property will be donated to the city. <br /> Mr. McQueen presented the recommendation of staff: <br /> Original approval was granted in 1974 to a different company for <br /> mining purposes and changes have been made to alter the <br /> boundaries as needed. The operation has not changed in any way <br /> and is not seen as detrimental to nearby property. Due to the <br /> error in the legal description, the petitioner will be back next <br /> month to further amend the plan for expansion into an existing <br /> sludge lagoon owned by the city. Staff recommends approval of <br /> the petition as presented. <br /> Mr. Kaptain questioned the berm elevation. Mr. Roadruck stated <br /> that the berm was installed many years ago but it doesn't keep <br /> the water out. Vulcan is not mining the berm out; mining will be <br /> done up to the berm. <br /> � It was moved and seconded (Hunt/Pronk) that Cal. No. 93-53 be <br /> recommended to City Council for approval per staff <br /> recommendation. Motion carried unanimously. <br /> Cal. No. 93-37 Petition of GEORGE C. WEAVER, ACTING DIRECTOR <br /> OF COMMUNITY DEVELOPMENT, to amend Section <br /> 22. 76. (Historic Neighborhood Use) of the <br /> Zoning Ordinance (Ord. #3512) . <br /> Mr. Weaver stated that in 1978, the City Council provided for a <br /> Historic Neighborhood Use which is a defined area in the west <br /> part of the community that allows special use to occur if the <br /> residential character of the area is not altered. A total of 186 <br /> historic landmarks were also designated and the majority of those <br /> are located in the historic district. Approximately 30 of the <br /> landmarks are outside the district. Staff recommends that the <br /> term landmark as established by ordinance be included in the <br /> definition allowing special use to be created in the properties. <br /> Mr. Gruenewald questioned if the owners of the landmarks know <br /> they are subject to this guideline. Mr. Weaver stated that this <br /> would be more enabling, allowing preservation of the landmarks <br /> and use in a more intensive way. <br /> Mr. Thomas questioned if the use would be heard by the Plan <br /> • Commission.
