Kr. Potter stated that it, !or inetance, a aulti-lamily structure <br /> was destroyed by fire then the Btructure could not be rebuilt as <br /> �ulti-tamily. <br /> Mr. KcQueen acknowledqed receipt ot two letters: one lrom the <br /> owner of 615 Neat Prairie (which is a aulti-family structure) who ' <br /> had oriqinally Biqned the petition and subsequently aeked that <br /> her siqnature be removed. The second letter was from the o�mers <br /> at 627-629 West Prairie who had purchased a multi-family <br /> structure aB an income property and a place to live in when <br /> retired. Their concern is that if the structure is destroyed by <br /> fire they are not allowed to reconstruct as sulti-family. It was <br /> noted that the R-6 zoninq has been in existence for more than <br /> thirty years eince the adoption of the Zoning Ordinance. . <br /> Mr. KcQueen etated that staff has ditficulty gupportinq the <br /> rezoninq qiven the number of properties excluded. There are <br /> eiqht lote out of 21 included in thie petition (38�) for which <br /> owners did not siqn. The sinqle family zoninq iB �ore <br /> reetrictive than what currently exietB. The zoninq bounda.ry lfne � <br /> would be irregular if only those siqninq the petition were <br /> ��� included in the rezoninq and, therefore, the qoal of the <br /> :::�� petitioner would not be accomplished. Staff recommende denial of . <br /> the petition. <br /> Kr. Kaptain questioned to what axtent damaqe nust be in order to <br /> not rebuild ag �ulti-lamily. Mr. KcQueen stated that i! � <br /> restoration would axceed 50 percant of the coet of rebuildinq the <br /> entire structure, then reconstruction as �nulti-family would not <br /> be allowed. It waB noted that potential buyers and lendinq <br />' institutions are concerned reqardinq this factor. <br /> l�r. 8unt questioned how purchasinq and reconBtruction ie affected <br /> as the property iB located in the historic diBtrict. l�ir. KcQueen <br /> stated that certain improvements and construction in the historic <br /> �diBtrict are reviewed by the Historical and Architectural� Sites <br /> Commiseion which encouraqes improvement and conBtruction to be in <br /> keepinq with the area and hietorical inteqrity of the structure. <br /> lir. Gruenewald queStioned how lot sizes would be affected. lir. <br /> McQueen atated that downzoninq would not affect the construction <br /> of einqle family dwellinqe ae the lote are lote of record. <br /> . It waB moved and Beconded (Pronk/Gruenewald) and unanimouely <br /> approved to forward Cal. No. 93-25 to City Council with <br /> recommendation for denial. <br /> ~ . l�ir.
