, , . ORDINANCE NO. 93-39 ORDINANCE GRANTING SPECIAL PERMIT ' PLANNED UNIT DEVELOPMENT NW CORNER OF ARBOR DRIVE AND N. OAKLAND AVENUE , WHEREAS, on the 6th day of May, 1993 , upon due notice, the Decatur City Plan Commission held a public hearing upon the ' petition of Jim Romano for a special use permit for an R-5 and B-1 Planned Unit Development on premises situated in the City of Decatur, Illinois, and described in Exhibit A attached hereto and hereby made a part hereof; and, WHEREAS, said Decatur City Plan Commission did report its findings and did recommend that said petition be granted. NOW, THEREFORE, BE IT ORDAINED, BY THE CITY COUNCIL OF THE CITY OF DECATUR, ILLINOIS: Section 1. That the report and recommendation of the Decatur City Plan Commission be received, placed on file and approved. Section 2 . That upon the conditions hereinafter mentioned, a special use permit be, and it is hereby granted to Jim Romano to develop the premises described on Exhibit A under an R-5 and B-1 Planned Unit Development in accordance with the plat and plans hereto attached, marked Exhibit B and hereby made a part hereof. Section 3 . That said permit be, and the same is hereby, expressly conditioned as follows: (a) Prior to development of said premises, detailed construction plans and specifications including, but not limited to water mains, sanitary sewers, storm sewers, fire hydrants, streets, parking lots, driveways and landscaping shall be submitted to and approved by the Director of Public Works and Director of Community Development. (b) Al1 internal streets and the storm sewer system shall be privately owned and maintained. (c) A utility easement shall be granted for water mains and sanitary sewers, which utilities shall be maintained by the City of Decatur.
