Corporation Counsel <br /> RE: City Code Chapter 44 paragraph 5 amendments <br /> For the past number of years the City has had a problem with <br /> Class C fireworks being sold to persons who do not have a permit <br /> to purchase Class C fireworks. Although the sellers are aware <br /> that a purchaser must present proof that they can purchase the <br /> fireworks the sellers have found ways around the requirement. <br /> Last summer the City received numerous complaints that fireworks <br /> were being sold to persons without permits. In response, the City <br /> conducted an investigation which resulted in the confiscation of <br /> truckloads of fireworks. In an attempt to stop the illegal sale <br /> of Class C fireworks, controls have been added to the City Code <br /> Chapter 44 paragraph 5. These include requiring the seller to <br /> maintain detailed records of every sale, requiring proof that the <br /> purchaser has a valid permit to purchase, and making the holder <br /> of a permit to sell fireworks responsible for the illegal sale of <br /> fireworks by his employees. None of these requirements should <br /> pose any financial burden on either the seller or purchaser. As <br /> the season for fireworks is fast approaching, these guidelines <br /> need to be in place as soon as possible. An Ordinance amending <br /> Chapter 44 paragraph 5 has been placed on the Council agenda for <br /> May 17. <br /> Staff recommends approval of the Ordinance. <br />
