.

COMMUNITY DEVELOPMENT MEMORANDUM
NO. 93-71

May 10, 1993
TO: Honorable Mayor Erik C. Brechnitz and
City Council Members
FROM: James C. Bacon, Jr. , City Manager .
George C. Weaver, Community Development Acting Directo
SUBJECT: Shorewood Estates Residence Development Plan Amendment,
Lots 8, 9 and 10
On March 4, 1993 the Decatur City Plan Commission heard the
petition of Paul D. Hopkins to amend a special use permit for
Lots 8, 9, and 10 in Shorewood Estates, Third Addition. The
existing plan calls for three single family lots. Previous plans
have been approved for duplex and multi-family construction.
The Plan Commission heard the request by the petitioner to allow
for the construction of six duplex units. The Plan Commission
recommended approval of the plan as presented. Following the
action of the commission, the petitioner requested that the
actual number of units be reduced from twelve to eight. Because
the petitioner sought a reduction in the number of units, no
action was required by the Plan Commission.
The petitioner seeks one of two actions by the City Council in
the interest of moving this project along. The first
alternative is for four duplex lots along Millstream. The
petitioner respectfully requests the Council to consider an
alternative in the event the Council does not support the
recommendation of the Plan Commission. The petitioner asks that
the Council approve the four single family lots along Millstream.
Staff recommended approval of the proposal as presented to the
Plan Commission and, therefore, has no reservations in
recommending the approval of the four duplex lots.
Council members should be aware that an objection to the petition
has been received containinq the signatures of more than 20
percent of adjacent and/or contiguous property owners. This will
require a vote of five council members to approve the petition of
Mr. Hopkins.
