� <br /> . • <br /> , , <br /> WHEREAS, access to Martin Luther King Jr. Drive from the <br /> parcels or lots from which said premises are taken or acquired by <br /> the City should be restricted; and, <br /> WHEREAS, it is necessary and desirable that said premises <br /> and said access rights be acquired for the purpose aforesaid. <br /> NOW, THEREFORE, BE IT ORDAINED, BY THE CITY COUNCIL OF THE <br /> CITY OF DECATUR, ILLINOIS: <br /> Section 1 . That it is, and it is hereby determined to be, <br /> necessary and desirable that the City, in order to extend said <br /> MLK Jr. Dr. as aforesaid, acquire title to the real properties <br /> described above, including access rights from said remaining <br /> parcels or lots . <br /> Section 2 . That it is hereby determined that the aforesaid <br /> real properties, including access rights, and the acquisition <br /> thereof are necessary for a public use and purpose. <br /> Section 3. That he City Manager and the Corporation <br /> Counsel, jointly and severally, be, and they are hereby, <br /> authorized and directed to cause said real properties, including <br /> access rights, to be acquired on behalf of the City, and in the <br /> event the same is not able to be acquired by agreement with the <br /> owner or owners thereof upon the compensation or consideration to <br /> be paid or furnished for the same, or in the event title thereto <br /> is defective, then title to and possession of said real property, <br /> including access rights, shall be acquired by and for the City by <br /> the exercise of condemnation under the Eminent Domain law of the <br /> State of Illinois. <br /> Section 4 . That this Ordinance be in full force and effect <br /> from and after its passage. <br /> PRESENTED, PASSED, APPROVED AND RECORDED this 21st day of <br /> December, 1992. <br /> , � <br /> �� �---� <br /> ERIK C.
