PETITION FOR ZONING ORDINANCE AMENDMENT <br /> October 22, 1991 <br /> TO: Mayor Gary K. Anderson <br /> Decatur City Council <br /> Decatur City Plan Commission <br /> I, David A. Clark, Director of Community Development, hereby <br /> request amendment of Section XXI.C. of the Zoning Ordinance (Ord. <br /> #3512) such that said section as amended shall read as follows: <br /> C. PLANNED UNIT DEVELOPMENT: <br /> Planned Unit Development: An authorized �agent of the Municipal, <br /> County, State; or Federal Government or the owner or owners of <br /> any tract of land �lassified in the R-1, R-2, R-3, R-5, R-6, <br /> 0-1, B-1, B-2 , M-1, or M-2 zoning districts or any combination <br /> thereof, may submit a plan for the use and development of all of <br /> the tract of land in accordance with the land use regulations of <br /> the respective underlying zoning classification. The development <br /> plan shall be referred to the City Plan Commission for study and <br /> for public hearing. Notice and publication of such public hear- <br /> ing shall conform to the procedures prescribed in Section XXVII <br /> for hearings on changes and amendments. After receipt by the <br /> Commission and determination of a recommendation, such plans <br /> shall be submitted to the City Council for consideration and ac- <br /> tion. Final action by the City Council shall be determined by <br /> majority vote. <br /> In the course of review and recommendation of a Planned Unit <br /> Development, the Plan Commission and the City Council shall con- <br /> sider the following: <br /> 1. Compatibility with the character of the surrounding <br /> neighborhood and general area. To this end, the <br /> Commission may required in the absence of an <br /> appropriate physical barrier, that uses of <br /> least intensity and/or a buffer of green space <br /> or screening be arranged along the borders of <br /> the project. <br /> 2 . The effect of the proposed Planned Unit Development <br /> upon the immediate area. <br /> 3 . Whether or not an exception from minimum zoning <br /> regulations as herein stated is warranted by <br /> virtue of the design and amenities incorporated in <br /> the development plan. <br /> 4 . That the proposed Planned Unit Development is in <br /> accordance with the general intent of this <br /> Zoning Ordinance and the Decatur Urban Area Land <br /> Use Plan. <br />
