ORDINANCE AMENDING ZONING ORDINANCE - RESIDENTIAL-CARE HOMES - WHEREAS, on the 2nd day of August, 1990, upon due notice, the Decatur City Plan Commission held a public hearing on the petition of David A. Clark, Director of Community Development, to modify and amend the Zoning Ordinance of the City of Decatur, the same being Ordinance No. 3512, as amended, regarding residential- care homes; and, WHEREAS, the Decatur City Plan Commission did report its findings and did recommend that said petition be granted and that the Zoning Ordinance be so modified and amended. NOW, THEREFORE, BE IT ORDAINED, BY THE CITY COUNCIL OF THE CITY OF DECATUR, ILLINOIS: Section 1 . That the report and recommendation of the Decatur City Plan Commission be, and the same are hereby, received, placed on file and approved. Section 2 . That the Zoning Ordinance of the City of Decatur, as amended, be, and the same is hereby, modified and amended at Section II. (19) thereof so that as so modified and amended said Section II . (19) of said Zoning Ordinance provides as follows: "19 . FAMILY: Either: (a) Two or more persons, each related to the other by blood, marriage, or adoption, together with usual domestic servants and not more than one bona fide guest, all living together as a single housekeeping unit and using common kitchen facilities; or (b) Eight or fewer persons, all of whom are not necessarily related to each of the others by blood, marriage, or adoption, all living together as a single housekeeping unit and using common kitchen facilities. For purposes of this Zoning Ordinance, however, an unrelated family shall not include persons living together in a Residential-Care Home, Nursing Home or Foster Home. " Section 3 . That the Zoning Ordinance of the City of Decatur, as amended, be, and the same is hereby, further modified and amended at Section II . (70) thereof by the repeal of said Section I I. (7 0) .
