n, <br /> ♦ <br /> ORDINANCE NO. - �d � <br /> ORDINANCE REZONING PROPERTY AND APPROVING <br /> AN R-3 RESIDENCE DEVELOPMENT PLAN <br /> - HICKORY POINT APARTMENTS - <br /> WHEREAS, on the 12th day of December, 1989 , upon due notice, <br /> the Decatur City Plan Commission held a public hearing upon the <br /> Petition of Patrick C. Nolan, on behalf of Roy Mosser, to rezone <br /> premises described as follows: <br /> SEE EXHIBIT A ATTACHED HERETO AND <br /> . HEREBY MADE A PART HEREOF <br /> from R-1 Single Family Residence District to R-3 Single Family <br /> Residence District, and for a special permit under the provisions <br /> of Section XXI (C) of the Zoning Ordinance to construct and <br /> operate an R-3 Residence Development Plan on such premises; and, <br /> WHEREAS, said Plan Commission has reported to the Council <br /> and has recommended approval of said rezoning and Residence <br /> Development Plan and that the same be permitted upon the <br /> conditions and limitations hereinafter set out. <br /> NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br /> DECATUR, ILLINOIS: <br /> Section 1 . That the recommendations of the Decatur City <br /> Plan Commission be, and the same are hereby, received, placed on <br /> file and approved. <br /> Section 2 . That said described premises be, and they are <br /> hereby, rezoned from R-1 Single Family F:esidence District to R-3 <br /> Single Family Residence District. <br /> Section 3 . That upon the conditions and limitations <br /> hereinafter set out, a special permit be, and it is hereby, <br /> granted to Roy Mosser, and only to Roy Mosser, to develop, <br /> construct and operate upon the premises aforesaid an R-3 <br /> Residence Development Plan in accordance with the plat thereof <br /> hereto attached, marked Exhibit B and hereby made a part hereof. <br /> Section 4 . That the special permit authorized hereby be, <br /> and the same is hereby, granted subject to the following <br /> conditions: <br /> (a) That said residence development be constructed in <br /> accordance with Exhibit C attached hereto and hereby made a part <br /> hereof. <br />
