, . . . , <br /> WATER SERVICE AGREEMENT <br /> For and in consideration of the undertakings and covenants set out herein, <br /> it is agreed by and befinreen the Owner(s) of the premises described at paragraph <br /> 8 hereof, and which person or persons are signatory hereto, ("Owner"), and THE <br /> CITY OF DECATUR, ILLINOIS, ("city"), as follows: <br /> 1. The provisions of this Agreement, and the installation, operation and <br /> use of the water service authorized hereby are expressly made subject to all <br /> applicable provisions of codes, ordinances, rules and regulations of City, and , <br /> Owner agrees to comply therewith. <br /> 2. After completion of the construction of a watermain by the City in the �I <br /> street or roadway adjacent to the premises described herein, and upon obtaining <br /> a tapping permit in the customary manner followed by the City for premises <br /> within its corporate limits, Owner may tap said watermain of City and connect a <br /> water service thereto to furnish residential service only to said premises. <br /> 3. Said tap, connection and service shall be made and installed by a <br /> licensed plumber. <br /> 4. The water furnished by City shall only be used for domestic purposes <br /> and only upon the premises described herein. <br /> 5. At such time as said premises become contiguous to the corporate <br /> limits of City, the then Owner of said premises shall, within ninety (90) days after <br /> receiving notice from City thereof, petition to annex the same to the City. <br /> 6. This Agreement shall terminate upon the failure by Owner to comply <br /> with any provision hereof or with any applicable provision of City Code, <br /> ordinances, rules or regulations, or upon the annexation of said premises to the <br /> City, and may be terminated by either party upon six (6) months notice by <br /> certified mail to the other, addressed to One Gary K. Anderson Plaza, Decatur, <br /> IL, 62523, if to the City, or to Z�'i�3 �,A��c.9,,.�� ��� , if to the <br /> Owner. <br /> 7. This Agreement is intended for the benefit of said premises as well as <br /> the current owner and occupant thereof and to said end shall be binding upon <br /> and insure to the benefit of said owner and his successors in title. <br />► <br />
