Vaughan <br /> DATE : April 27 , 1988 <br /> RE: City Code Revisian Concerning Operations of Bottle <br /> Clubs <br /> Attached memo from J <br /> ohn Couter contaa.ns the suggested city code <br /> change which would attack the issue of the illegal operation of <br /> Bottle Clubs in the city. <br /> Formerly the city �ode regulated "Bottle Clubs" only from the <br /> standpoint of hours of operation (Chap. 49 . , Sec . 18) . This <br /> created all types of subterfuge being erected by these late hours <br /> clubs in terms of charging front door admission and dispensing <br /> free drinks ; club membership with member-stored liquor ; when in <br /> essence one could walk in from the street and buy drinks in these <br /> clubs (or pay the door charge ) ; all of which constitued <br /> violations of city code and state statutes . <br /> Under the proposed provisions the simple direct approach is to <br /> prohibit the possession, storage or consumption of liquor (after <br /> hours) at any type of operation which lacks a city liquor <br /> license . This approach allows a "no nonsense" enforcement <br /> process that can be accomplished without launching a covert <br /> investigation culminating in a warrent-armed "raiding party" with <br /> the attendant over-time cost . <br /> The essence of this proposal is the distinction between a class <br /> "C" club licensed establishment and a "Bottle Club or similar <br /> place" which has no license . <br /> This proposal does not impact upon a rental hall or similiar <br /> place wherein weddings or parties are held , as long as they don ' t <br /> sell liquor (previously prohibited) or store , possess or consume <br /> liquor after hours (new proposal) . <br /> I would recommend that we proceed with this section as soon as <br /> practical without awaiting other changes in the code , as we are <br /> ; now enjoying a certain amount of momentum as a result of several <br /> "raids" and notices of nuisance abatement against such <br /> operations . <br /> cc : John Couter <br />
