�, r. <br /> ( 1) a Memorandum of Agreement dated April 1, 1988 <br /> (the "Memorandum of Agreement" ) between the <br /> Municipality and the Corporation under the terms of <br /> which the Municipality agrees, subject to the <br /> provisions of such Agreement, to issue the Bonds for <br /> the purposes described above; <br /> ( 2) A draft of a Preliminary Official Statement <br /> to be used in connection with the sale of the Bonds <br /> (the "Preliminary Official Statement" ) ; and <br /> ( 3) A draft of a Purchase Contract to be dated on <br /> or about April 21 , 1988, between the Municipality and <br /> the Underwriter and approved by the Corporation and <br /> Decatur Memorial Hospital ( the "Purchase Contract" ) . <br /> NOW, THEREFORE, BE IT ORDAINED by the Council of the <br /> City of Decatur, Macon County, Illinois, as follows: <br /> Section l. That the Municipality is a home rule unit <br /> under the provisions of the 1970 Constitution of Illinois, and as <br /> a home rule unit may, under the powers granted by Section 6(a) of <br /> Article VII thereof, "exercise any power and perform any function <br /> pertaining to its government and affairs. " That this ordinance <br /> is adopted pursuant to the Municipality' s home rule powers and in <br /> accordance with the Enabling Ordinance, any provisions contained <br /> in the Illinois Municipal Code to the contrary nvtwithstanding. <br /> Section 2. That the form, terms and provisions of the <br /> Memorandum of Agreement be, and they hereby are, in all respects <br /> -3- <br />
