O / ` �I �/ ORDINANCE AMENDING SPECIAL USE PERMIT - M-2 EXTRACTIVE USE - - SOUTHSIDE DRIVE - WHEREAS , on the lst day of October, 1987 , upon due notice, the Decatur City Plan Commission held a public hearing upon the petition of Vulcan Materials Company, owner of the premises described herein, to amend and modify a special use permit for �� the extraction of sand and gravel granted by Ordinance No. 5991 to Howard W. Arnold and his successors in title for premises legally described as shown on Exhibit A attached hereto and hereby made a part hereof; and, � WHEREAS , said Decatur City Plan Commission did report its findings and did recommend that the modification of said special use permit as requested be authorized. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF DECATUR, ILLINOIS : Section 1. That the report and recommendation of the Decatur City Plan Commission be, and the same is hereby, received, placed on file and approved. Section 2 . That said Ordinance No. 5991 be, and the same is hereby, modified and amended as follows : (a) That Section 3 of Ordinance No. 5991 be, ar�d the same is hereby, modified and amended so that as so amended said Section 3 provides as follows : "That upon the conditions and limitations set out herein for a period ending December l, 2004 , a special permit be, and it is hereby, granted VULCAN MATERIALS COMPANY and its successors in title, to use, maintain and operate •the premises aforesaid for the purpose of extracting sand and gravel therefrom and for no other use or purpose except such incidental uses as are found by the Director of Community Development to be I necessary to accomplish such extraction. " (b) That Section 4(d) of Ordinance No. 5991 be, and the same is hereby, modified and amended so that as so amended said Section 4(d) provides as follows :
